Who we are

Kartivo is operated by two affiliated entities. Which one you contract with, and which law applies, depends on the currency you are billed in.

These Terms of Service govern your access to and use of the Kartivo platform. By creating an account or using Kartivo you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

Which entity you contract with

If you are billed in Indian Rupees (INR), your contract is with Webliska Technologies (Proprietorship), Faridabad, Haryana, India. If you are billed in US Dollars (USD) or any other currency, your contract is with Webliska Technologies, Inc., San Jose, California, USA. "Kartivo", "we" and "us" refer to whichever of those entities contracts with you.

The service

Kartivo provides software for selling digital products and services online — checkout and payment links, funnels, subscriptions, courses and member delivery, reporting, and related tools. We may add, change or withdraw features; where a change materially reduces functionality you rely on, we will give reasonable notice.

Your account

• You must provide accurate registration details and keep them current.
• You are responsible for activity under your account and for keeping credentials secure.
• Tell us promptly at Contact@webliska.com if you suspect unauthorised access.

Fees, billing and taxes

• Subscription fees are shown on our pricing page and are charged in advance for the billing period you select.
• Currency and taxes. Indian customers are billed in INR and Goods and Services Tax (GST) applies at the prevailing rate, shown separately on your tax invoice. Customers billed in USD are charged exclusive of any local taxes, which are your responsibility.
• Subscriptions renew automatically for successive periods unless cancelled before the renewal date. You can cancel at any time from your account.
• Failed payments may be retried. If payment remains unsuccessful we may suspend access until the balance is cleared.
• We may change pricing with at least 30 days' notice. Changes take effect at your next renewal.

Refund eligibility, windows and processing timelines are set out in our Refund Policy, which forms part of these Terms.

Payments to you, and your customers

Where you use Kartivo to collect payments, those payments are processed by third-party gateways under your own agreement with them. You are responsible for the products and services you sell, for the accuracy of your own pricing, tax and refund terms, and for fulfilling and supporting your customers. You must publish your own refund, privacy and contact information where the law or your gateway requires it.

Acceptable use

You may not use Kartivo to sell or distribute anything unlawful; to infringe intellectual property; to send unsolicited bulk messages; to engage in fraud, deceptive pricing, or activity prohibited by your payment provider; to attempt to breach or probe our security; to reverse engineer the platform; or to resell it without written permission.

Intellectual property

We own the platform, its software and branding. You own the content you upload and the data you and your customers generate. You grant us a limited licence to host, process and transmit that content solely to operate the service for you.

Third-party services

Kartivo integrates with third parties such as payment gateways, email providers and advertising platforms. Your use of those services is governed by their terms, and we are not responsible for their acts or omissions.

Suspension and termination

You may cancel at any time; access continues to the end of the paid period. We may suspend or terminate an account for material breach of these Terms, non-payment, or where required by law or a payment provider. Where practicable we will give notice and an opportunity to remedy. On termination you may export your data for a reasonable period before deletion.

Warranties and disclaimers

We provide the platform with reasonable skill and care, but it is provided "as is" without warranties of uninterrupted or error-free operation, or of any particular commercial result. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill or data. Our aggregate liability arising out of or relating to these Terms is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim.

Indemnity

You agree to indemnify us against claims arising from your content, the products or services you sell, or your breach of these Terms or of applicable law.

Governing law and jurisdiction

If you contract with Webliska Technologies (India): these Terms are governed by the laws of India, and the courts at Faridabad, Haryana have exclusive jurisdiction.

If you contract with Webliska Technologies, Inc.: these Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Santa Clara County, California have exclusive jurisdiction.

Changes to these Terms

We may update these Terms. Material changes will be notified by email or in-product notice at least 30 days before they take effect, except where a change is required by law or for security, which may take effect immediately. Continued use after the effective date constitutes acceptance.

We acknowledge complaints within 48 hours and aim to resolve them within 30 days of receipt. Please include your account email and a description of the issue so we can identify your records.
